The Principle of Separation of Powers: An Analytical Study of Its Advantages and Disadvantages and Constitutional Effects

The principle of separation of powers are considered one of the most important constitutional guarantees upon which the rule of law rests, as it ensures respect for rights and guarantees the exercise of freedoms. This means preventing the concentration of power in the hands of a single body and the necessity of distributing state functions among the legislative, executive, and judicial branches of government, with each branch having oversight over the others. This study aims to demonstrate the importance of the principle of separation of powers, examine its most important features, and identify the criticisms leveled against it. It also seeks to understand its role in protecting the principle of legality and its impact on safeguarding individual rights and freedoms. The study employs an analytical approach to explain the concept of the principle of separation of powers, its various forms, its most important advantages and disadvantages, and to analyze its role in protecting rights and freedoms. The study concludes that the principle of separation of powers means distributing state functions among several independent bodies. Furthermore, the principle of separation of powers are not meant to be rigid but rather flexible, and its adoption is considered the most important constitutional guarantee for limiting injustice and abuse of power and protecting individual rights and freedoms from infringement by public authorities.
